Terms of service

The agreement between Durbar and the people who use it: organizers, venues, institutions, rental vendors and renters, Studio customers and print partners, companies sending gifts, buyers, bookers and voters.

Draft for legal review

This is a draft dated . It isn't in force yet and will change after review by a lawyer. Items in square brackets are still to be filled in.

About these terms

These terms are between you and Silentech [registered name, registration number and address to be added], which makes Durbar. By creating an account, buying a ticket, making a booking, renting equipment, ordering from a print partner, voting, or using a link Durbar sends you, you agree to them.

Organizations that use Durbar to sell or issue tickets, take bookings, rent out equipment, run a vote or send gifts are called "organizers" here. People who buy tickets, book spaces, rent equipment or buy votes are "buyers". Businesses that make and deliver Studio orders and gift kits are "partners".

Your account

You sign in with a one-time code sent to your phone or email, or with a passkey. Keep your phone, email and devices secure; you're responsible for what's done in your account.

An organization's owner decides who joins its team and with which role, and is responsible for what its team does.

If you organize events or let out spaces

You agree to:

  • describe your events and spaces accurately, including prices, times, places and any age or access limits;
  • honour the refund policy you choose and show buyers, and the refunds Durbar processes under it;
  • run your event or keep your booking as described, or cancel it through Durbar so buyers are refunded;
  • meet your own legal duties, including registering for and charging VAT and other taxes where they apply, and holding any licence or permit your event needs;
  • use buyers' personal data only for the event or booking it was given for, as our privacy notice and the law require.

Fees and payouts

Our fees are on the pricing page. We take them from the organizer's share of each paid order, or from the partner's share of a Studio order; we don't add fees to the price buyers see.

Payments are taken and split by licensed payment providers (Paystack, with Hubtel as a fallback). Your share is sent to the MoMo or bank account you set up, on the provider's schedule. Durbar never pools or holds your money: the provider splits each payment through its licensed split accounts. The provider's own terms also apply.

When a buyer is refunded, your share of that order is taken from your next payout.

Rentals and deposits

A rental is between the vendor and the renter. Durbar runs the marketplace and the order, and takes its fee (on the pricing page) from the rental and the delivery, never from the deposit.

Vendors agree to describe their equipment and its condition honestly, deliver and collect when agreed, and take condition photos when it goes out and when it comes back. Those photos are the record both sides rely on.

The renter pays the rental, delivery and deposit together. The deposit is paid to the vendor's payout account and held against loss or damage. After the return, the vendor releases it or keeps part of it within their claim window, and must give the renter a reason. What isn't kept goes back to the way the renter paid. If the claim window closes with no decision, the whole deposit goes back.

A renter who disagrees with a claim can answer it from their order page. That opens a support case that Durbar follows up with both sides, using the photos and the order's record. [How a dispute is decided, and by when, to be set before launch.]

A renter can cancel a rental that isn't paid yet. To cancel a paid rental, ask the vendor, who handles the refund.

Studio, print partners and gift kits

A Studio order is between the customer and the partner who makes it. The quote is the partner's price; Durbar adds nothing to it and takes its commission from the partner's share.

Production starts only when the proof is approved and the deposit is paid. Approving a proof, yourself or through the approval link, means the item is made exactly as that proof shows, so check names, spellings and colours first. The balance is due before dispatch or on delivery, as the order says.

Partners agree to make the item to the approved proof, check it with photos before dispatch, and record delivery only with a photo and the delivery code texted to the recipient. A partner's link is private to that job: don't share it.

A company sending gift kits is responsible for having the right to give us its recipients' phone numbers and emails, and for using what recipients tell us (addresses and sizes) only to deliver their gift.

Voting

The organizer sets the contest's rules, prices and limits, and is responsible for the contest and its prizes. Durbar takes its fee on paid votes from the organizer's share.

A paid vote counts only once the payment provider confirms the payment. A free vote needs a one-time code sent by SMS to the voter's phone, and each phone is held to the contest's limit.

Each vote is recorded once. Each hour's votes are sealed into a public hash chain, and each new head is signed and published, so anyone can check what was published against a copy they kept. Votes whose payment is reversed come off the count, in public. Voting is for awards and audience polls: don't use it for a binding election such as an SRC or AGM vote.

An organizer can void votes they believe broke the rules, with a reason that is shown publicly. Voided paid votes are refunded to the voter, through the payment provider or by the organizer outside Durbar. Otherwise, votes that were counted can't be refunded.

Don't vote with someone else's phone or payment account, or with software or bulk payments meant to get round a contest's limits.

If you buy tickets or book spaces

You buy from the organizer, not from Durbar. The organizer is responsible for the event or the space. Their refund policy is shown before you pay.

If an event is cancelled, you're refunded in full to the way you paid. If its date moves, you can ask for a refund until it starts. Within the organizer's policy, you can refund your own order from your ticket page.

A ticket is let in once. You can pass a ticket on to someone else from your ticket page before the event; the old code then stops working. Don't copy, resell above face value or forge tickets.

Using Durbar fairly

Don't use Durbar to:

  • sell tickets to events that don't exist, or that you have no right to sell;
  • send messages people haven't agreed to receive, or invite or gift people whose details you have no right to use;
  • point a smart item's link at anything harmful, deceptive or unlawful;
  • break the law, or harm, harass or deceive anyone;
  • get into accounts or data that aren't yours, or disrupt the service.

Your content

You keep the rights to what you upload, such as event descriptions and photos. You let us show it on Durbar and in links shared from it, for as long as it's published.

Suspending and closing accounts

We may pause an event or an account that breaks these terms, puts buyers at risk, or that the law requires us to stop, and we'll tell you why. You can leave an organization at any time from its Team page, unless you're its only owner. Durbar doesn't yet have a way to close an account yourself: to have your details erased, ask the organization or our data protection contact, as the privacy notice explains.

Our responsibility

We work to keep Durbar available and correct, but we can't promise it will never fail. To the extent the law allows, we aren't responsible for an event or a space itself, or for losses that come from an organizer's acts. Nothing in these terms limits the rights you have under Ghana's consumer protection law.

Law and disputes

These terms are governed by the laws of Ghana. If something goes wrong, contact us first and we'll try to put it right. Disputes go to the courts of Ghana.

Changes to these terms

If we change these terms in a way that matters, we'll tell account holders by email or SMS before the change applies.
